Terms and Conditions
Acceptance of these Terms
Pawaily LLC provides the Pawaily mobile application and related services, including learning content, guided sessions, activities, progress tools, reminders, support, and associated web pages. By creating an account or using the service, the account holder agrees to these Terms and the Privacy Notice. If an account holder does not agree, they must not use the service.
Eligibility and account responsibilities
The service is initially available in the United States. An account holder must be at least 18 years old or the age of majority where they live, whichever is older. Account holders must provide accurate information, protect their credentials, and notify Pawaily at support@pawaily.com about suspected unauthorized access. They are responsible for activity through their account except to the extent caused by Pawaily’s failure to protect it.
The service and important limits
Pawaily provides general educational and practical dog-owner guidance. It is not veterinary, medical, behavioral, legal, emergency, or professional-training advice. It is not a diagnosis, treatment plan, guarantee, or substitute for an in-person assessment by a qualified professional.
Do not use the service in an emergency or when a person, animal, or property may be at risk. Seek prompt help from an appropriately qualified veterinarian, behavior professional, trainer, emergency service, or other professional. Every dog and environment differs. The account holder must decide whether an activity is appropriate, supervise participants and their dog, use safe equipment and conditions, and stop an activity when there are signs of stress, fear, pain, aggression, injury risk, or unsuitability.
Your information and privacy
The Privacy Notice explains how personal information is processed through the Pawaily app and associated web pages and is part of these Terms. You are responsible for ensuring that information you provide is accurate and that you have the right to provide it. Do not submit personal information about another person unless you are authorized to do so. Do not submit confidential, highly sensitive, or emergency information unless we specifically ask for it and our Privacy Notice explains how we handle it.
Acceptable use
Account holders may use the service only for lawful, personal, non-commercial purposes. They may not harm, threaten, exploit, or harass a person or animal; violate animal-welfare laws; copy, sell, rent, license, distribute, publicly display, or create derivatives from the service without written permission; reverse engineer, bypass security, scrape, automate access, interfere with, or overload the service; upload malware; impersonate another person; misuse an account; or violate applicable law, platform rules, or third-party rights.
Intellectual property
Pawaily and its licensors own the service and its content. Subject to these Terms, Pawaily grants a limited, personal, revocable, non-exclusive, non-transferable, non-sublicensable license to use the service on devices the account holder owns or controls. Feedback and non-confidential suggestions may be used by Pawaily for lawful purposes without compensation.
Memberships, subscriptions, and purchases
Access to some or all Pawaily features may require a paid subscription. We may introduce paid access to features previously available without charge or discontinue access without a subscription. We will give affected account holders reasonable advance notice before an existing feature requires payment. Having a Pawaily account does not enroll you in a paid plan or authorize a charge. To obtain paid access, you must select a plan and confirm the purchase. Before confirmation, we will show the plan's features, price, currency, billing period, renewal terms, any trial or promotional terms, and how to cancel. See Subscriptions and Refunds.
Billing, cancellation, refunds, and restoration
If a plan renews automatically, it continues for successive billing periods until canceled through the method identified at purchase. The checkout terms will identify who charges you, when charges begin and recur, and how to manage or cancel the plan. If an offer includes a trial or introductory price, checkout will show its duration, the price and billing period afterward, and how to cancel before a charge. Cancel before the next renewal to avoid the next charge. Cancellation does not by itself refund a past charge; access generally continues through the paid period unless the offer terms or applicable law provide otherwise. We will communicate price changes to an active subscription and obtain consent when required by law or the purchase provider. Refund eligibility follows the applicable purchase provider's policy and law. For billing or purchase-restoration questions, contact support@pawaily.com. Nothing in these Terms limits any non-waivable consumer right that applies to you.
Promotions and gift offers
If Pawaily offers a promotion, referral program, credit, gift offer, or discount, it may have additional terms shown with the offer. Unless those terms say otherwise, offers are personal, non-transferable, have no cash value, cannot be combined, and may be changed or ended as permitted by law. We may withhold or revoke an offer if we reasonably believe there is fraud, misuse, or an error.
Third-party services
The service may contain links to or integrate with third-party services. The Pawaily app is distributed through the Apple App Store and Google Play, and may use Apple or Google sign-in when you choose it. Those services are governed by their own terms and privacy practices. We do not control and are not responsible for third-party services, content, availability, or transactions. This does not reduce any rights you may have against Pawaily that cannot lawfully be excluded.
Service availability, changes, and suspension
We try to keep the service available, but it may be unavailable, interrupted, delayed, changed, or discontinued. We may maintain, update, suspend, restrict, or discontinue all or part of the service for security, legal, operational, or business reasons, subject to applicable law.
We may suspend or terminate access if we reasonably believe you violated these Terms, created a security risk, engaged in fraud or abuse, or must be restricted by law. We will provide notice when reasonably practicable. You may stop using the service at any time.
Disclaimers
To the fullest extent permitted by law, the service is provided as available and as is. Pawaily disclaims warranties to the extent permitted by law, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, and uninterrupted or error-free operation. Pawaily does not promise a particular outcome. Nothing limits rights that cannot lawfully be excluded.
Limitation of liability
To the fullest extent permitted by law, Pawaily is not liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, data, goodwill, or business opportunities arising from the service or these Terms. This does not limit liability that cannot lawfully be limited, including statutory consumer rights.
Indemnity
To the extent permitted by law, you will defend, indemnify, and hold harmless Pawaily and its affiliates, licensors, directors, officers, employees, and agents from claims, damages, losses, liabilities, costs, and expenses, including reasonable legal fees, arising from your unlawful use of the service, your breach of these Terms, or your violation of another person’s rights. You will not have this obligation to the extent a claim results from our own negligence, willful misconduct, or violation of law.
Governing law and disputes
Pennsylvania law governs these Terms, excluding conflict-of-law rules, except where the law of an account holder’s usual residence provides protections that cannot be waived. The courts in Pennsylvania have exclusive jurisdiction, subject to non-waivable consumer rights. These Terms contain no arbitration agreement.
Before filing a claim, you and Pawaily agree to try to resolve the dispute informally by sending a written notice to support@pawaily.com with your name, contact details, a description of the issue, and the relief requested. This process does not prevent either party from seeking urgent injunctive relief or exercising rights that cannot be waived. Mandatory consumer protections prevail over conflicting provisions in these Terms. Nothing in these Terms limits your right to contact a consumer-protection authority or bring a claim where the law allows.
Changes to these Terms
We may update these Terms when we change the service, legal requirements, or our business practices. If a change is material, we will give reasonable advance notice through the service, by email, or another lawful method. The revised Terms apply on the stated effective date. If a change requires your consent under applicable law, we will obtain it. If you do not agree to a material change, you may stop using the service before the change takes effect. Continued use after the effective date means you accept the updated Terms to the extent permitted by law.
General terms
These Terms and the Privacy Notice are the entire agreement between you and Pawaily about the service, except for any separate written agreement we sign with you. If one provision is unenforceable, the remaining provisions remain in effect and the invalid provision will be enforced to the greatest extent permitted by law.
You may not assign or transfer these Terms or your account without our written consent. We may assign these Terms in connection with a merger, acquisition, restructuring, sale of assets, or by operation of law, provided your statutory rights are not reduced. Our failure to enforce a provision is not a waiver. These Terms do not create a partnership, employment, agency, or joint venture. No third party has rights under these Terms.
